Terms of Service
Last updated: 21 October 2026
1. Who we are
The services on this website are provided by Khachatur Martirosyan, a self-employed professional (autónomo) registered in Spain.
- NIF: Z1494828V
- Address: C/ CONCA, 47 P06 011, 46008 Valencia, Spain
- Email: legal [at] funderce.com
These terms apply to services bought on funderce.com or agreed with us directly, however they are paid. Orders placed through a third-party platform follow that platform's terms, including its payment and refund rules.
2. Who the services are for
Our services are for founders, businesses and professionals, acting for a business they run or are preparing to launch. By ordering, you confirm that you are buying for that purpose. If you buy as a consumer, the rights that consumer law gives you still apply in full, and where these terms say so, a different rule applies to you.
3. Services
We offer strategy sessions, mentorship, audits and reviews, and done-for-you work such as conversion optimization, store and funnel builds, and custom development, as well as any other service we describe on our website or in a proposal. Sessions and mentorship are advice: you decide what to do with it and carry it out. The scope of done-for-you work is what the order or proposal describes; anything else is a new order or a change agreed in writing. A signed proposal or agreement prevails over these terms where they differ.
4. Prices and payment
- Prices are shown without VAT. VAT or other taxes are added at checkout where they apply.
- Payment is made by card through Stripe, or by bank transfer or another method shown on our invoice. We never see or store your card details.
- Work starts once payment is received. A session is booked first and paid straight after; a booking that is not paid within the time shown at booking is released.
- Extra time on a call can be added before the call, or during it when the schedule allows it that day, in 30-minute blocks at the session rate. It is paid through the link we send.
- Credits. Where an offer says part of its price is credited toward a next service (for example an entry check toward the full audit of the same kind within 7 days, or an audit toward its implementation within 30 days), the credit applies once, to the service named, if that service is ordered within the stated period. It is deducted from that order's price, cannot be combined with another credit, and has no cash value.
- Invoices for business customers are due on the date shown. An unpaid invoice carries late-payment interest and a fixed recovery fee of EUR 40 under Spanish late-payment law (Ley 3/2004), and work may pause until it is paid.
5. Sessions
- Booked time. The time you book is reserved for you. The session ends at the booked end time.
- Waiting time. Each side waits 15 minutes. If you have not joined by then, the session counts as held and is not refunded. If we have not joined by then, the session is rescheduled or refunded, at your choice.
- Joining late. If you join late, the session still ends at the booked end time.
- Ending early. If you end a session early, or do not need the rest of the time, the unused time is not refunded. If we have to end it early, the remaining time is rescheduled or refunded.
- Booking. Sessions are booked through our booking page in any free slot it shows, or arranged with us directly by email or message. A slot shown as free can be booked.
- Rescheduling and cancelling. You can reschedule or cancel up to 24 hours before the start, with a refund (section 8). Later changes and no-shows are not refunded.
6. Mentorship
- Plans and price. Your plan, price, call hours and anyone else included are set in your mentorship order or on our pricing page when you subscribe. The Founder plan covers the founder only. A Team plan covers the people named in your order, counted across calls, messages and reviews.
- Adding people or changing plan. Adding a person to a Team plan, or moving from Founder to Team, starts on the day it is paid. That first payment, and the call hours added for that month, cover only the days left in the current month; the new monthly price and hours apply from the next renewal. Removing a person takes effect at the next renewal.
- Billing period. Mentorship is paid monthly in advance and renews each month on the date you started (if that date does not exist in a month, on its last day), until cancelled.
- Failed payments. If a renewal payment fails, our payment provider notifies you and retries. Mentorship pauses until the month is paid; if it is still unpaid after 14 days, the subscription ends and nothing is owed on either side for that month.
- Hours. Call hours are for the current month. Unused hours do not carry over and are not refunded. If we miss or shorten a session, that time is rescheduled within the month or refunded pro rata.
- Messages between calls. Short questions by email or an agreed channel are included; we aim to reply within two business days. Longer topics go to a call. We do not offer on-demand calls outside booked sessions.
- More time. Time beyond your hours is booked as extra time at the session rate.
- Cancelling. You can cancel at any time before your next renewal; you keep mentorship until the end of the month already paid, which is not refunded.
- Price changes. We may change the price of a plan, including a plan no longer offered, with 30 days' written notice. The new price applies from the next renewal after the notice; you can cancel before then.
- Prelaunch mentorship. It is for campaigns launching at least 12 weeks after you start; results depend on the time left before launch. It ends when your campaign launches: the month in which the launch falls is billed only up to the launch date you give us, and if the launch date moves, we adjust that month. Help after launch is a different service.
7. Audits, reviews and done-for-you work
- What we need from you. Timelines assume you provide the access, content and answers we ask for.
- Orders on hold. If you do not provide them within 14 days of our request, the order is placed on hold and the timeline is released; we tell you in writing. When you are ready, we schedule the next available slot, which may be later than the original date.
- Closed orders. An order that stays on hold for 60 days is closed, and we send you a summary of the work done so far. For business customers, the fee for a closed order is not refunded. For consumers, the part of the fee for stages not yet started is refunded.
- Stages. Unless the order says otherwise, work is valued in three stages: research and analysis (access, data, reports and review of your business) 40%; planning and production 40%; delivery and handover 20%. A stage counts as started once we begin work on it. Restarting a closed order is a new order at the prices then in force.
- Revisions. The revisions included are the ones the order states, within its original scope.
- Your store and accounts. Where we work in your store or accounts, you give us only access you are entitled to give. Changes are made with your approval; publishing is your decision.
- Audit access. For audits we ask for read-only access where the platform offers it (a read-only key, a viewer or analyst role). Audits change nothing in your accounts. You can remove our access as soon as the report is delivered.
- Third-party data. Some audits also use data about your website from independent data providers, such as search rankings and links from other sites. These are their estimates; we state where a figure comes from.
- Your content must be lawful. You confirm that what you supply (products, images, copy, data) is yours to use and lawful, and does not infringe anyone's rights. We may refuse or stop work involving content that is unlawful, infringing, sexually explicit or otherwise in breach of the platforms' rules; work already done is not refunded in that case.
8. Refunds
- Cancelled 24 hours or more before a session, or before work has started on an order: refunded. For business customers we keep the payment processing fee, which Stripe does not return to us. Consumers receive the full amount.
- Time or work we did not deliver (a missed session, shortened time, work we cannot complete): refunded pro rata, or rescheduled if you prefer.
- Anything else (a late cancellation, a no-show, unused time, delivered work) is not refunded. We may still offer a refund or credit in a particular case, at our discretion.
- Refunds go back to the original payment method.
- Repeated cancellations or orders left idle. After two refunded cancellations, or two orders closed while on hold, within six months, we may decline further orders from you. For business customers, we may instead accept them as non-refundable.
- Disputes with your bank. Please contact us before disputing a payment with your bank. A dispute over a session that was held or work that was delivered is answered with the booking, attendance and delivery records.
9. Consumers: right of withdrawal
If you are a consumer in the European Union, you can withdraw from a service contract within 14 days of ordering, without giving a reason, by writing to legal [at] funderce.com. If you ask us to start within those 14 days, which you do by booking a session or asking us to start work, you pay for what was provided until you withdraw, and you lose the right of withdrawal once the service has been fully provided. If you withdraw before a session starts or before any work is done, you are refunded in full, even where section 5 or 8 would otherwise not refund you.
10. Recordings
We do not record our calls. If you want to record one for your own notes, tell us before it starts; we may ask you not to. Neither side shares or publishes a recording of the other without consent, and we never use your image or voice in our marketing without your separate consent.
11. Confidentiality
We keep your business information confidential and use it only to provide the service, unless you agree otherwise or the law requires disclosure. We may name you as a client (your first name and initial or your public handle, and your brand), link the public campaign or store we worked on, show its public figures such as a campaign's funding total, and quote reviews you published. Any other result we describe without details that identify you. You can ask us in writing not to name you. In turn, you keep confidential our non-public methods, frameworks and working materials that you see during a service. Our internal working files are not part of the deliverables.
12. Intellectual property
- Your materials. What you give us (content, data, brand assets) stays yours. You allow us to use it only to provide the service.
- Deliverables. We keep the ownership of everything we create, including code, designs and documents made for you. Once paid, you receive a permanent, worldwide licence to use, change and keep using the deliverables for your business, which passes with the business if you sell it. Copy and content written about your own products are yours once paid.
- Our materials. Our methods, frameworks, templates, tools and reusable components remain ours. You may not resell, sublicense, republish or rebrand our deliverables or materials as your own product or service.
- Our website and tools. You may not copy, scrape or harvest our website, tools or materials by automated means, reverse engineer them, get around their access limits, or use them unlawfully or to build a competing product.
13. No guarantee of results
We give our best professional judgement, but results depend on your product, market, budget, execution and third-party platforms. We do not guarantee sales, conversion rates, funding or any other result.
14. Third-party platforms
Platforms such as Kickstarter, Indiegogo, Shopify and Meta set their own rules and may change them. You are responsible for following their terms. We are not responsible for their decisions, outages or changes. Their names are trademarks of their owners; we are independent of them and not endorsed by them, except where a partnership is stated (such as the Kickstarter Expert Partner program).
15. Liability
For business customers, our total liability in connection with an order is limited to the price paid for that order, and we are not liable for indirect loss, such as lost profit or lost opportunity. Business customers are responsible for claims by third parties arising from the content, data or access they supplied, or from how they used our advice. For consumers, our liability follows consumer law. Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, for gross negligence or wilful misconduct, or any liability that cannot be limited by law.
16. Who does the work, and your customers' data
- We may involve trusted team members or subcontractors in delivering a service. We remain responsible for their work and they are bound by the same confidentiality.
- We use software tools, including AI tools, to analyse data and draft deliverables. A person reviews every deliverable before it is sent, and these tools are not allowed to use your data to train their models.
- We ask only for the access the work needs, and avoid access to your customers' personal data where the work allows it. Where access does include their personal data (for example orders in your store or subscribers in your email platform), we process it only on your instructions and to deliver the service, under the data processing terms at funderce.com/data-processing, which form part of these terms. You accept them with these terms by ticking the box when you pay, and we keep a record of that acceptance; a signed agreement with us includes them instead.
17. Ending a service
We may end a service if you do not pay, or if communication becomes abusive. In that case we refund the part of the service not yet provided.
18. Events beyond control
If either side is prevented from performing by an event outside its reasonable control, timelines move by the length of the event. If it lasts more than 30 days, either side may cancel the undelivered part, which is refunded.
19. Changes to these terms
We may update these terms. The version in force when you placed an order applies to that order.
20. General
If a court finds part of these terms invalid, the rest still applies. These terms are written in English. After a service ends, confidentiality continues for five years, and the intellectual property and liability sections continue without time limit.
21. Law and disputes
These terms are governed by Spanish law. If you are a consumer, you keep the protection of the mandatory laws of the country where you live, and you can bring a claim in the courts there. Before going to court, write to us at legal [at] funderce.com and we will try to resolve it.
